Common thinking points a finger at the administrative state for the growth of regulations, but Langer challenges common thinking to consider the role of Congress in encouraging expansive regulations.
“I was testifying up on the Hill…and the congressman said ‘Who’s fault is this?’, expecting me to blame the EPA or the Department of the Interior, [or] whomever. I said, ‘Well, frankly, Congressman, it’s your fault because you guys have had ample opportunity to make changes to laws and not give the agencies this power’,” Langer explains.
The blame can extend even further to the judicial system, which like Congress has remained inactive to keep the administrative state and the regulations it produces in check. The result is a burdensome and swollen regulatory state that exercises unprecedented power and authority over the lives of Americans while bypassing the proper legislative process.
